Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your use of InFLOW Engine, including inflowengine.com, app.inflowengine.com, our forms, booking pages, and text-message programs (together, the “Services”). The Services are provided by InFLOWential Inc, a Florida corporation (“InFLOWential Inc”, “we”, “us”, or “our”). By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. The Services
InFLOW Engine is a customer relationship platform that helps businesses manage contacts, conversations, appointments, and follow-up. Some features rely on third-party providers (for example Twilio, Zoom, Stripe, and Google), and their availability may depend on those providers.
3. Accounts
Access to the InFLOW Engine app is by invitation or agreement with us. You must be at least 18 years old, give accurate information, and keep your login credentials secure. You are responsible for activity under your account.
4. Client Responsibilities
If you use InFLOW Engine to contact your own customers, you are responsible for that content and for obtaining and keeping any consent the law requires — including consent for text messages and calls under the TCPA, CTIA guidelines, and carrier rules, and for email under CAN-SPAM. You may not use the Services to send spam, unlawful, deceptive, or harmful content, or to contact anyone who has not consented or has opted out.
5. SMS / Text Messaging Program Terms
InFLOWential Inc offers two separate text-message programs. You can join either one, both, or neither — each has its own checkbox, and neither is ever pre-selected.
- Account & appointment messages (non-marketing). Appointment confirmations and reminders, account notifications, and replies to your inquiries. Message frequency depends on your activity.
- Marketing messages. Offers, events, and announcements from InFLOWential Inc. Message frequency varies, approximately 2–4 messages per month.
How to opt in. You opt in by entering your mobile number on one of our web forms and ticking the checkbox for the program(s) you want. After you opt in, you will receive a confirmation text welcoming you to the program. Consent to receive text messages is not a condition of any purchase.
Message and data rates may apply. Charges depend on your mobile carrier and plan. Carriers are not liable for delayed or undelivered messages.
How to opt out. Reply STOP (or CANCEL, END, QUIT, UNSUBSCRIBE, or STOPALL) to any message to stop receiving texts. You will receive one final message confirming you have been unsubscribed. To rejoin, reply START or opt in again on our form.

You confirm that you are the owner or authorized user of the mobile number you provide, and you agree to tell us if that number changes. We handle your mobile information as described in our Privacy Policy; it is never shared with third parties or affiliates for marketing or promotional purposes.
6. Fees and Payment
Paid plans and services are billed as described in your order, proposal, or plan, and payments are processed by Stripe. Unless your written agreement says otherwise, subscriptions renew automatically until cancelled, and fees already paid are non-refundable. You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period.
7. Intellectual Property
The Services, including their software, design, and content, are owned by InFLOWential Inc or its licensors. You keep ownership of the data you put into the Services, and you give us permission to host and process it only to provide the Services to you.
8. Disclaimers
The Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free, or any particular business result.
9. Limitation of Liability
To the fullest extent permitted by law, InFLOWential Inc will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the 12 months before the claim, or $100 if you paid nothing.
10. Indemnification
You agree to indemnify and hold InFLOWential Inc harmless from claims arising from your use of the Services, your content, or your violation of these Terms or the law — including messages you send to your own customers through the Services.
11. Suspension and Termination
We may suspend or end your access if you violate these Terms, misuse the Services, or create risk for us, our providers, or others. You may stop using the Services at any time.
12. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction.
13. Changes
We may update these Terms from time to time. We will post the updated version on this page with a new “Last updated” date. Continued use of the Services after a change means you accept the updated Terms.
